These Terms of Use ("Terms") govern access to and use of the publicly accessible pages operated by MODRN, LLC, doing business as MODRN RN COLLECTIVE ("Company"): the Agency Accountability Index and the State of Travel Nursing Annual Report (collectively, the "Public Pages"). No account or membership is required. By accessing any Public Page, you agree to these Terms.
Nature of Public Pages
Agency Accountability Index
A quarterly-updated ranked list of staffing agencies based on verified nurse-submitted reviews from MODRN RN Collective members. A minimum of 10 verified reviews per agency per quarter is required for ranking.
State of Travel Nursing Annual Report
An annual report using verified nurse-contributed data covering pay benchmarks, contract clause findings, agency rating trends, housing costs, staffing ratios, and negotiation outcomes. The next edition is Q1 2027, covering 2026 data.
Data Source and Accuracy Disclaimer
2.1 Nurse-Reported Data
All scores, ratings, data, and findings on the Public Pages are based exclusively on information submitted by verified MODRN RN Collective members with active NURSYS-verified nursing licenses. Data is not editorially assessed or independently verified beyond confirming submitter identity.
2.2 No Warranty of Accuracy
Company makes no representation or warranty that any data, score, rating, or finding is accurate, complete, current, or error-free. Data reflects nurse-reported experiences at a point in time and may not reflect current conditions. Company expressly disclaims all warranties, express or implied, regarding the accuracy or reliability of Public Page content.
2.3 Nurse-Reported — Not Editorial
Scores and rankings reflect what nurses reported—not the opinions, assessments, or editorial judgments of Company. Company does not rate or editorially evaluate any agency or facility.
Section 230 Protection
The Public Pages publish third-party user-submitted content protected by Section 230 of the Communications Decency Act (47 U.S.C. § 230). Company is an interactive computer service provider and is not the author of the underlying nurse-submitted content. No agency, facility, employer, or other entity may bring a cause of action against Company based on the substance of nurse-submitted ratings, reviews, or data published on the Public Pages.
FCRA Disclaimer
The Public Pages are not consumer reporting agencies under the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.). Public Page data may not be used as a "consumer report" for employment, staffing, credentialing, credit, insurance, or housing decisions about any individual nurse. Any such use is prohibited and may expose the user to independent FCRA liability.
Prohibited Uses
- Making or informing employment, credentialing, staffing, or assignment decisions about any individual nurse.
- Identifying, contacting, or attempting to identify any nurse who submitted a rating or review.
- Using Public Page data as the basis for any legal claim or adverse action against any individual nurse.
- Scraping or systematically extracting data using automated tools without the Company’s prior written consent.
- Reproducing, republishing, selling, or commercially exploiting any Public Page content without prior written consent.
- Attempting to reverse-engineer the identity of any nurse contributor from aggregate data.
- Any use that violates applicable law, including the FCRA, state privacy laws, or anti-discrimination laws.
Permitted Uses
- Individual nurses researching agencies or market conditions for personal career decision-making.
- Journalists, researchers, and academics citing the State of Travel Nursing Report with attribution: “MODRN RN Collective, State of Travel Nursing [Year], modrnrncollective.com.”
- Nursing educators sharing reports with students for educational purposes with attribution.
- Labor researchers and policy advocates citing aggregate findings with attribution.
- Agencies reviewing their own scores for internal quality improvement purposes only.
Citation format
MODRN RN Collective ([Year]). State of Travel Nursing [Year]: Annual Data Report. modrnrncollective.com. Data window: [period]. Include the section number when citing specific findings.
Minimum Threshold Disclosure
Agency Accountability Index scores require a minimum of 10 verified nurse reviews per agency per quarter. State of Travel Nursing Report facility-level data requires a minimum of 25 verified submissions. Agencies and facilities below threshold are shown as "Insufficient data." These thresholds protect individual nurses from identification and support statistical reliability.
No Endorsement
Company does not endorse or recommend any agency or facility listed or described on the Public Pages. Presence on the Agency Accountability Index is not a recommendation. Rankings reflect available verified review data only. Agencies may not pay for better placement. Scores are determined exclusively by verified nurse reviews.
Intellectual Property
All Company-authored content on the Public Pages—including design, layout, report structure, methodology descriptions, and original narrative text—belongs to MODRN, LLC and is protected by copyright. Nurse-submitted underlying data is licensed to Company by members. Citation under permitted uses does not require separate consent. All other reproduction requires prior written consent from Company.
Limitation of Liability
To the maximum extent permitted by law, Company is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from use of or reliance on any Public Page content. Company's aggregate liability to any Public Page user is limited to one hundred dollars ($100).
Governing Law
These Terms are governed by the laws of the State of California. Disputes arising from use of the Public Pages shall be resolved in the state or federal courts of Los Angeles County, California.
Changes
Company may update these Terms at any time by posting a revised version on the Public Pages. Continued access constitutes acceptance of the revised Terms.
